Terms and Conditions for DivineMind Ltd Retreats with Accommodation
All Retreat participants must make themselves aware of the terms & conditions & accept the risks associated with the Retreat activities. Each guest must be responsible for taking out the appropriate personal accident, holiday, cancellation & Covid cover insurance policy for the full duration of their chosen Retreat, this is a non-negotiable condition when booking one of our Retreats. We recommend that this is arranged at the time of booking.
These terms and conditions (“Conditions”) shall apply to and be incorporated into your booking form and prevail over any inconsistent terms or conditions contained, or referred to, in your booking form or confirmation of booking.
1. Introduction
1.1 These terms and conditions govern your booking of a retreat package holiday with DivineMind Ltd (hereinafter referred to as "we", "us", or "our").
1.2 By making a booking, you agree to comply with and be bound by these terms and conditions.
2. Booking and Payment
2.1 A non-refundable deposit of 20% is required at the time of booking to secure your reservation.
2.2 The balance of the Retreat package price must be paid in full no later than 21 days before the start date of the Retreat. Failure to pay the balance by the due date may result in the cancellation of your booking and forfeiture of the deposit.
2.3 Payments can be made via the websitewww.divinemind.love
2.4 By booking on this Retreat you are accepting that the Conditions apply to your booking. Upon receipt of the deposit, we will send you a booking confirmation by email. This confirmation is our formal acceptance of the booking. Please check the details of the confirmation and advise us at once of any inaccuracies. If we do not hear from you withing 5 days of sending the booking confirmation then the information on the booking confirmation shall be deemed to be correct.
RESPONSIBILITIES OF THE CLIENT:
- The fee does not include travel to & from the Retreat’s country at which the proposed services shall be provided. The arrangement and payment of travel to and from the Retreat’s country shall be the sole responsibility of the client.
DivineMind Ltd may, at additional cost, provide an airport transfer for those who wish to take it. This would be arranged separately with separate Terms and Conditions.
- The client is responsible for their own personal medical needs / requirements, clothing & footwear for the duration of the services unless otherwise agreed in writing with DivineMind Ltd.
3. Cancellations and Refunds
3.1 If you wish to cancel your booking, you must notify us in writing as soon as possible.
3.2 Cancellation charges will apply as follows:
- More than 21 days before the Retreat start date: 20% of the total Retreat package price.
- 21 days, or fewer, days before the retreat start date: 100% of the total Retreat package price. If full payment has not been made then you are liable for the full cost of the holiday. We recommend that you arrange insurance for holiday cancellation (as soon as you book). We may take into consideration any unforeseen circumstances that take place regarding your cancellation, and it is at our discretion to offer an alternative arrangement.
Refunds are made minus any applicable/relevant bank charges or card payment fees, plus an administration fee of £150.00per client. Bank transfer refunds are made in either UK Sterling or Euros. Refunds are made minus any third-partycommissions where applicable.
3.3 DivineMind Ltd reserves the right to cancel bookings without refund, if they feel that they have a good reason to do this because that booking may affect the Retreat in some way. This includes but is not limited to unreasonable behaviour of the client. When the cancellation of the booking is due to the unreasonable behaviour of the client, DivineMind Ltd reserve the right to offer no refund.
3.4 DivineMind Ltd reserves the right to ask participants to leave the Retreat if their behaviour is disruptive to the running of the Retreat or other participants or staff. If you withdraw from the Retreat at anytime, or if you are requested to leave due to disruptive behaviour, no part of the Retreat fee shall be refunded. In the case of our decision to ask you to leave, all matters arising from a dispute are subject to English law and are subject to the jurisdiction of the English courts.
3.5 We reserve the right to cancel the Retreat in the event of unforeseen circumstances, however, DivineMind Ltd are not liable for refund of booking fees due to any event beyond our control.
Events beyond our control include: war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, earthquakes, fire, pandemics, epidemics, health risks, technical problems with transport, hurricanes and other actual or potential severe weather conditions, theft and any other similar events.
Limitation of Liability
This condition sets out our entire financial liability (including any liability for the acts or emissions of our employees, teachers, consultants and suppliers) to you in respect of: (a)any breach of our contract; (B) any use made by you of the Retreat or the services we provide to all arrange for you; And (C) any representation, payment or tortious act or omission (including negligence) arising under or in connection with our contract for the Retreat.
• All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from our contract. • Nothing in these conditions limits or excludes our liability: (a) for death or personal injury resulting from negligence; Or (B) for any damage or liability incurred by you as a result of our fraud or fraudulent misrepresentation. • Our total liability to you in relation to you in tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with our contract and the Retreat shall be limited to the price you pay to us.
In the event of unforeseen circumstances, excluding the events beyond our control listed above, then DivineMind Ltd will offer to reassign the client to a Retreat at an alternative date.
3.7 The contract may be assigned by the client to a third-partysubject at all times to conditions.
The client is unable to assign or transfer the contract to a third party without the prior written consent of DivineMind Ltd. If the client wishes to assign their contract, he or she must give notice in writing to IAM@divinemind.love, providing the full name, address & contact details of the third party. DivineMind Ltd shall then advise in writing as to if it consents to the assignment as soon as is reasonably possible. DivineMind Ltd reserves the right to refuse an assignment to a third party at any time and without reason. If subsequently a client has to cancel due to DivineMInd Ltd refusing the assignment to a third-party then the cancellation charges under cancellation by the client shall apply.
4. Changes to Your Booking
4.1 If you wish to make changes to your booking, please contact us at IAM@divinemind.love as soon as possible. We will do our best to accommodate your request, but we cannot guarantee that changes will be possible.
4.2 Any changes to your booking may incur additional charges.
4.3 DivineMind Ltd reserves the right to change any price of the Retreat before the contract becomes binding.
4.4 After the booking has been made there may be occasions when it is necessary to make changes to the accommodation provided. In this case the client will be notified as soon as possible. DivineMind Ltd shall seek to offer the client arrangements as close to the original as it is reasonably possible in the circumstances.
4.5 Although we will always endeavour to adhere to the dates of the booked Retreat, after the booking has been made there may be occasions when it is necessary to make changes to the dates of the Retreat. We reserve the right to do this. In this case the client will be notified as soon as possible. If this change means the client can no longer attend then DivineMind Ltd shall seek to offer the client new dates that are suitable for them.
4.6 Although we will always endeavour to adhere to the published programme of activities, we reserve the right to amend the itinerary and Retreat programme at any time.
4.7 DivineMind Ltd may assign or sub-contract to any third party the performance of any of its obligations under the contract without consent of the client.
5. Travel Insurance
5.1 It is your responsibility to obtain comprehensive travel insurance that covers the activities included in the Retreat package, as well as potential risks such as trip cancellation, personal injury, and loss of personal belongings.
5.2 We strongly recommend that you purchase travel insurance at the time of booking.
6. Health and Safety
6.1 You are responsible for ensuring that you are in good mental and physical health and physically and mentally able to participate in the Retreat activities.
6.2 You must inform us of any medical conditions, or special requirements at the time of booking. You must also inform us if you are pregnant, have a mental health issue, or are taking any medication. We will not, under any circumstances, be held responsible for injury, loss or death, howsoever arising, during your stay. It is your responsibility to ensure that your physical and mental condition is appropriate to the accommodation and activities relevant to the holiday that you are booking.
6.3 Although we will endeavour to accommodate your special requirements, we cannot guarantee that all needs can be met. Particular dietary arrangements are for the client to discuss and arrange directly with the hotel accommodation. DivineMind Ltd bears no responsibility for this however will assist wherever possible.
6.4 We reserve the right to refuse participation in certain activities if we believe it may pose a risk to your health and safety.
7. Accommodation and Food
7.1 Half-board accommodation is provided as part of the Retreat package.
7.2 Any special requirements for accommodation must be requested in writing to DivineMind Ltd at the time of booking. Failure to do so within 5 days of booking, (or immediately at the time of booking if the booking is made 30 days or less, prior to the commencement of the Retreat) may result in these special requirements not being met.
7.2 You are responsible for any damage to the accommodation caused by you during your stay.
8. Retreat Activities
8.1 The Retreat package includes a range of activities as described in the Retreat information. Participation in these activities is voluntary.
8.2 We reserve the right to alter the schedule of activities due to weather conditions, availability of instructors and/or facilitators, or other unforeseen circumstances.
9. Liability
9.1 We are not liable for any loss, damage, injury, or illness that occurs during your stay, except where such loss, damage, injury, or illness is due to our negligence.
9.2 You agree to indemnify and hold us harmless from any claims, actions, or damages, including legal fees, arising out of your participation in the Retreat activities.

10. General
Although DivineMind Ltd take every reasonable care to ensure that nothing untoward occurs during your Retreat, we accept no responsibility or liability whatsoever for any injury, loss, accident, death, delay, inconvenience, damage or irregularity arising, howsoever caused (to the fullest extent permitted by law). We do not accept responsibility whatsoever for events beyond our control. Similarly, we do not accept responsibility for breakdown in the supply of water, gas or electricity; We will however endeavour to arrange for such problems to be resolved as promptly as possible. We have taken the greatest care in the preparation of the information presented to you and every effort has been made to ensure accuracy. We do our utmost to ensure that the Retreat venue is satisfactory and enjoyable.
Our contract and any disputes or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with our contract or its subject matter or formation (including non-contractual disputes or claims). If any part of our contract is deemed by the laws of England and Wales, to be unfair or unjust the remainder of our contract shall remain valid.
11. Privacy
11.1 We are committed to protecting your privacy and will only use your personal information in accordance with our Privacy Policy.
11.2 By making a booking, you consent to our use of your personal information as described in our Privacy Policy.
12. Acceptance of Terms
12.1 By booking a Retreat package with us, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
